The Rajastan state government has begun booking sex determination crimes under Section 315 of the IPC. This entails up to 10 years in prison or fine or both. The said section pertains to an Act meant to prevent a child born alive to die after birth. This puts it in a higher punishment bracket than the PC-PNDT Act.
Under the PC-PNDT Act, the violators could be imprisoned for upto three years while the upper-cut on the fine is ten thousand rupees. In the case of subsequent conviction, imprisonment could be up to five years and the fine, fifty thousand rupees.
The authorities apparently have already begun implementing the new rule, having lodged multiple cases under this section.
